Terms and Conditions of the pivexin-tech.com store
The terms used in the Terms and Conditions mean:
- Customer – a natural person, legal entity, or organizational unit without legal personality, which regulations grant legal capacity, who places an Order within the Store. If you are a company or purchasing on behalf of a B2B entity, please refer to the GTC in the B2B section.
- Civil Code – the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);
- Terms and Conditions – these Terms and Conditions for the provision of electronic services within the pivexin-tech.pl online store;
- Online Store (Store) – a website available at www.pivexin-tech.com, through which the Customer can, in particular, place Orders;
- Goods – products presented in the Online Store;
- Sales Agreement – a contract for the sale of Goods within the meaning of the Civil Code, concluded between pivexin-tech.pl and the Customer, using the Online Store’s website;
- Consumer Rights Act – the Act of May 30, 2014, on consumer rights (Journal of Laws 2014, item 827);
- Electronic Services Act – the Act of July 18, 2002, on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);
- Order – a declaration of will by the Customer, directly aimed at concluding a Sales Agreement, specifying in particular the type and quantity of the Goods.
- These Terms and Conditions specify the rules for using the online store available at www.pivexin-tech.com.
- These Terms and Conditions are the regulations referred to in Article 8 of the Electronic Services Act.

- These Terms and Conditions specify, in particular: the conditions and rules for placing Orders electronically within the online store; the rules for concluding Sales Agreements using services provided within the Online Store.
- Using the online store is possible provided that the IT system used by the Customer meets the following minimum technical requirements: The E-Store works with the following browsers: Google Chrome 26 and higher, Internet Explorer 9 and higher, Mozilla Firefox 20 and higher.
- To use the online store, the Customer should independently obtain access to a computer or terminal device with internet access.
- According to applicable laws, pivexin-tech.pl reserves the right to limit the provision of services via the Online Store to persons who have reached the age of 18. In such a case, potential Customers will be notified.
- Customers can access these Terms and Conditions at any time via a link on the homepage of the website www.pivexin-tech.com and download or print them.
- The condition for starting to use the Online Store is registration. Registration is done by filling in and accepting the registration form, available on one of the Store’s pages. The condition for registration is acceptance of the Terms and Conditions and providing personal data marked as mandatory.
- Pivexin Technology Sp. z o.o. may deprive the Customer of the right to use the Online Store, as well as limit their access to part or all of the Store’s resources, with immediate effect, in case of violation of the Terms and Conditions by the Customer, and in particular, when the Customer:Â
- provided during registration in the online store data that is untrue, inaccurate, or outdated, misleading, or violating the rights of third parties,
- committed through the online store violations of personal rights of third parties, in particular, personal rights of other customers of the online store,
- committed other behaviors that are considered by pivexin-tech.pl as inconsistent with applicable laws or general internet usage rules or harming the reputation of pivexin-tech.pl.Â
- A person who has been deprived of the right to use the online store cannot register again without prior consent from pivexin-tech.pl.
- To ensure the security of message and data transmission in connection with services provided within the Website, the Online Store implements technical and organizational measures appropriate to the level of security threats of the provided services, in particular, measures aimed at preventing the acquisition and modification of personal data transmitted over the Internet by unauthorized persons.Â
- The Customer is obliged in particular to:Â
- not provide or transmit content prohibited by law, e.g., content promoting violence, defamatory, or violating the personal rights and other rights of third parties,
- use the Online Store in a way that does not disrupt its operation, in particular, by using specific software or devices,
- not take actions such as: sending or placing unsolicited commercial information (spam) within the Online Store,
- use the Online Store in a way that is not burdensome for other customers and for pivexin-tech.pl,
- use all content posted within the Online Store only for personal use,
- use the Online Store in accordance with the laws applicable in the territory of the Republic of Poland, the provisions of the Terms and Conditions, and the general rules of internet use.
- To conclude a Sales Agreement through the Online Store, you must visit the website www.pivexin-tech.com, make a selection by taking subsequent technical steps based on messages displayed to the Customer and information available on the website.
- The selection of ordered Goods by the Customer is made by adding them to the cart (sample photos may differ from the actual product).
- During the Order placement – until the button confirming the Order is clicked – the Customer can modify the entered data and the selection of Goods. To do this, follow the messages displayed to the Customer and information available on the website.
- After the Customer using the Online Store provides all necessary data, a summary of the submitted Order will be displayed. The summary of the submitted Order will include, among others, a description of the selected goods or services, total price, and all other costs.
- To send the Order, it is necessary to accept the Terms and Conditions, provide personal data marked as mandatory, and click the button confirming the Order.
- Information about the Goods provided on the Online Store’s website constitutes an offer within the meaning of Article 66 of the Civil Code. Sending the Order by the Customer is a declaration of will to conclude a Sales Agreement with pivexin-tech.pl, in accordance with the Terms and Conditions.
- The Agreement is considered concluded when the Customer’s Order is received by the Online Store’s IT system, provided the Order complies with the Terms and Conditions. After concluding the agreement, the Customer receives an email containing confirmation of all essential elements of the Order.
- The Sales Agreement is concluded in Polish, with content consistent with the Terms and Conditions.
- Delivery of Goods is limited to the Czech Republic, Germany, and is made to the address indicated by the Customer during the Order placement.
- Delivery of ordered Goods is carried out via:
- Courier company
- Own transport
- Oversized freight
There is an option for personal pickup of the ordered goods at our store: Pivexin Technology Sp. z o.o., ul. Wyrobiskowa 4, 47-440 Babice, from Monday to Friday between 8:00 a.m. and 4:00 p.m., except for public holidays. When picking up the ordered goods at the store, you can pay in cash.
Delivery costs are as follows: All information regarding shipping costs is available in the “Shipping Costs” section. Additionally, the delivery costs will be indicated during the Order placement.
- The delivery time is as follows: All information regarding delivery time is available in the “Delivery Time” section and is counted from the day the Customer sends the Order.
- Customers can access these Terms and Conditions at any time via a link on the homepage of the website www.pivexin-tech.com and download or print them.
The recording, securing, providing, and confirming to the Customer the essential provisions of the Sales Agreement for Goods is done by sending the Customer an email to the provided address, and by including in the shipment containing the Goods a printout of the confirmation, Order specification, and VAT invoice.
- The prices of the Goods are given in Polish zloty and include all components, including VAT (with the indicated rate), customs duties, and all other components.
- The Customer can pay the price:Â
- by bank transfer
- cash on delivery (additional fee of: 2%
In the case of the “Bank Transfer” payment method, the customer pays for the order before its fulfillment. In the case of the “Cash on Delivery” payment method, the customer pays for the ordered goods upon delivery.
This paragraph applies exclusively to Customers who are consumers. Pursuant to Article 27 of the Act, Customers who are consumers have the right to withdraw from the contract within 14 days without giving any reason. The deadline for withdrawal expires after 14 days from the day on which you acquired the Goods or on which a third party other than the carrier and indicated by you acquired the Goods. To exercise your right of withdrawal, you must inform us (Pivexin Technology Sp. z o.o., ul. Wyrobiskowa 4, 47-440 Babice, bok@pivexin-tech.pl, Phone: +48 32 414 91 53) of your decision to withdraw from this contract by means of a clear statement (for example, a letter sent by post, fax, or email). You may use the standard withdrawal form template, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
In the event of withdrawal from this contract, we will reimburse all payments received from you, including the costs of delivery (except for additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay, and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods, which can be sent back by ordinary post. We will bear the cost of returning goods that, due to their nature, cannot be sent back by ordinary post. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
The consumer’s right to withdraw from the contract is excluded in the following cases:
- Contracts where the subject of the service is a non-prefabricated good, manufactured according to the consumer’s specifications or tailored to their personalized needs (goods subjected to mechanical or thermal processing, goods ordered on an individual basis).
- Contracts where the subject of the service is a good delivered in sealed packaging, which cannot be returned after opening the packaging for health protection or hygiene reasons, if the packaging was opened after delivery.
- Contracts involving Customers who are not Consumers.

- Pivexin Technology Sp. z o.o., as the seller, is liable to the Customer who is a consumer within the meaning of Article 22[1] of the Civil Code, under the warranty for defects in the scope specified in the Civil Code, in particular in Article 556 and Articles 556[1]-556[3] of the Civil Code.
- Complaints arising from violations of the Customer’s rights guaranteed by law or under these Terms and Conditions should be submitted to: Pivexin Technology Sp. z o.o., ul. Wyrobiskowa 4, 47-440 Babice, bok@pivexin-tech.pl. Pivexin Technology Sp. z o.o. undertakes to consider each complaint within 14 days, or, if this is not possible, to inform the Customer within this period when the complaint will be considered.
- Pivexin Technology Sp. z o.o. is the manufacturer of selected Goods available in the Store. For these Goods, Pivexin Technology Sp. z o.o., as the manufacturer, is liable under the warranty for the sold Goods under the terms and for the period specified in the warranty card. For Goods not manufactured by Pivexin Technology Sp. z o.o., the manufacturer may bear independent liability under the warranty for the sold Goods under the terms and for the period specified in the warranty card issued by the manufacturer. If the manufacturer’s warranty document provides for such a possibility, the Customer may submit claims under the warranty directly to the authorized service center, the address of which is provided in the warranty card.
- Pivexin Technology Sp. z o.o. takes measures to ensure the full and correct operation of the Store, to the extent resulting from current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.
- The Customer is obliged to immediately notify Pivexin Technology Sp. z o.o. of any irregularities or interruptions in the operation of the Online Store service.
- Irregularities related to the operation of the Store may be reported in writing to: Pivexin Technology Sp. z o.o., ul. Wyrobiskowa 4, 47-440 Babice, bok@pivexin-tech.pl.
- In the complaint, the Customer should provide their name and surname, correspondence address, type and date of the irregularity related to the operation of the Store.
- Pivexin Technology Sp. z o.o. undertakes to consider each complaint within 14 days, or, if this is not possible, to inform the Customer within this period when the complaint will be considered.
- Any disputes arising between Pivexin Technology Sp. z o.o. and the Customer who is a consumer within the meaning of Article 22[1] of the Civil Code shall be submitted to the competent courts in accordance with the provisions of the relevant Code of Civil Procedure.
- Any disputes arising between Pivexin Technology Sp. z o.o. and the Customer who is not a consumer within the meaning of Article 22[1] of the Civil Code shall be submitted to the court competent for the registered office of Pivexin Technology Sp. z o.o.
- For matters not regulated in these Terms and Conditions, the provisions of the Civil Code, the Act on providing services by electronic means, and other relevant provisions of Polish law shall apply.
